Registering Right to Manage

To register the Right to Manage (RTM) under the freehold title (Registering Right to Manage) of a property, you do this through HM Land Registry by entering a notice/restriction on the freehold title showing that the RTM company now manages the building.

This is not legally required, but it is good practice because it creates a public record.

Step 2: Apply to the Land Registry to enter a notice on the freehold title (Registering Right to Manage).

You need to apply for a unilateral notice or restriction on the freehold title stating the following:

“The Right to Manage under the Commonhold and Leasehold Reform Act 2002 has been acquired by [RTM Company Name].”

This is done using:

Form UN1 (Unilateral Notice)

or sometimes

Form RX1 (Restriction)

Most people use UN1

Documents you must send:

  1. Completed Form UN1 (Registering Right to Manage)
  2. Copy of: a) RTM claim notice b) Proof RTM has taken effect (e.g. counter-notice or date passed)
  3. RTM company details (companies house printout)
  4. Freehold title number (Registering Right to Manage)
  5. Covering letter requesting registration of RTM (Registering Right to Manage)
  6. Fee (usually £20)

File an application with the HM Land Registry. HM Land Registry will then notify the freeholder, and if no objection is raised, they will enter the notice on the freehold title.

Time frame:

Usually it will take 2-6 weeks (can be longer if there are objections)
