Immigration Appeal Procedure

If your visa is refused with the right of appeal, then you can lodge an appeal to the First Tier Immigration and Asylum Tribunal. If your visa is refused within the UK then you must lodge an appeal within 14 days of receipt of the notice of decision, however, if your visa is refused outside the UK then you can lodge an appeal within 28 days.

Please note that you should file grounds of appeal at the time of lodging an appeal and then skeleton arguments and paginated bundle.

A paginated bundle will consist of the witness statement of the appellant and any witnesses and evidence on which you will be relying. Once the appeal will be heard then the Learned Tribunal Judge will determine the appeal and you will normally receive it within 14 days.

Types of Immigration Appeals:

Oral Appeal: The Tribunal fee to lodge an Oral Appeal is £140.00

Paper Appeal: The Tribunal fee to lodge a Paper Appeal is £80.00

Immigration Appeal at the First Tier Tribunal:

Your appeal will be heard at the First Tier Immigration and Asylum Tribunal and moreover, it will be heard remotely due to Covid 19 Outbreak. Once the appeal will be heard then the Learned Immigration Judge might not deliver the Judgement on the same day but you will receive it within three to four weeks. If your appeal is dismissed then you can apply for permission to appeal to the First Tier Immigration and Asylum Tribunal. You must apply for permission to appeal to the First Tier Immigration and Asylum Tribunal within 14 days.
