A prohibited steps order” means an order that no step which could be taken by a parent in meeting his parental responsibility for a child, and which is of a kind specified in the order, shall be taken by any person without the consent of the court.
How To Apply for a Prohibited Steps Oder
Anyone with parental responsibility can make an application for a Prohibited Steps Order, provided that the child in question is under 16 years of age. This includes parents, or a person with a Child Arrangement Order.
You need to fill in C100 form and file it with the Family Court, however, prior to that you must attend a mediation but in certain circumstances you may be exempt to attend Mediation.
Upon receipt of the application, the court will consider whether granting the order is in the child’s best interests. The child’s welfare will always be the court’s most important priority when coming to this decision.
Cost of Applying PSO
The current fee for a Prohibited Steps Order application is £215. However, if you are on a low income or are in receipt of certain benefits, you may receive help to pay this cost.
The family court will conduct the hearing to find out whether it is necessary to grant the Order.
